EPA's Lead Based Renovator, Repair and Painter (RRP) Rule

What Property Managers Need to Know Before Hiring Contractors

What Is the EPA’s RRP Rule?

The EPA’s Lead Renovation, Repair & Painting (RRP) Rule (effective April 2010) requires that all paid renovation, repair, or painting work in pre‑1978 homes and child-occupied facilities—which disturbs lead-based paint—must be performed by Lead‑Safe Certified firms and overseen by at least one Certified Renovator who follows strict containment, dust control, and cleanup protocols.

Why Property Managers Must Pay Attention

Property managers often coordinate and oversee repairs—even if subcontracting the actual work. As of March 21, 2022, the EPA withdrew FAQs that previously exempted property management companies (PMCs) from certification if they hired certified firms. Now, PMCs are treated like contractors, and can be held liable if they: solicit bids, grant access, supervise work, inform tenants, verify completion, or pay vendors.

Risks of Hiring Uncertified “Handyman” Providers

One-man firms or low-cost contractors may skip the expensive RRP certification—but this invites serious risks:

  • Legal penalties: Violations can cost over $40,000 per day, with criminal penalties and even imprisonment possible for intentional breaches.

  • Health hazards: Lead dust exposure, especially dangerous to children and pregnant individuals, can happen without safe practices.

  • Property manager liability: If uncertified providers are used, PMCs could face enforcement actions even if they didn’t perform the work themselves.

Certification: Your Legal & Ethical Edge

By maintaining your EPA Lead‑Safe Certified Firm status and assigning Certified Renovators to jobs:

  • You stay compliant—avoiding steep fines and legal exposure.

  • You protect tenant health by ensuring lead-safe practices.

  • You differentiate yourself from uncertified handymen.

  • You enhance credibility with property owners and insurance partners.

Compliance Checklist for Property Managers

  1. Firm Certification: Confirm EPA or state-level Lead-Safe Certified Firm registration.

  2. Certified Renovators: Ensure a trained renovator is present on-site for every RRP job.

  3. Document Practices: Distribute Renovate Right pamphlet, contain work areas, perform cleaning verification, and keep records for at least 3 years.

  4. Vet Contractors: Require proof of certification from all subcontractors, including firm and renovator credentials.

  5. Track and Oversight: Monitor compliance, educate tenants before work begins, and retain all documentation.

For property managers, the EPA RRP rule isn’t optional—it’s a legal mandate with serious consequences. Your firm’s Lead-Safe certification proves your commitment to safety, compliance, and professionalism. Don’t risk health hazards or costly violations by taking shortcuts with uncertified providers.

Lead-Safe certification isn’t just a regulatory requirement—it’s a promise you’ll do right for tenants, properties, and your reputation. Let your RRP status work for you.
